Your use of our application and service is subject to the Terms of Use and this Privacy Policy and indicates your consent to them.

  

1. Definitions

 

"We", "us" and "our" means PT MEDIA DIGITAL ALACARTE, a company established under the laws of the Republic of Indonesia.  

 

"The Application" means a software application we have developed that serves as a means to find Services provided by third parties. 

 

"Service Provider" means a third party restauran and lifestyle merchants who provides Services through the Application. 

 

"Services" mean buy-1-get-1 complimentary privileges offered by a Service Provider through the Application. 

 

"Personal Information" means personally identifiable information about you that may be collected through the Application, such as your name, address, date of birth, gender, occupation, telephone number, email address, and/or the like, and other information that may enable identification of a specific individual who is using the Application. 

 

2. Information We Collect

 

We collect certain Personal Information from you for the Application. You will directly provide some Personal Information (e.g. when you sign up) and some will be collected automatically when you use the Application.

 

When you visit our Website, our website administrators process technical data such as your IP-address, visited webpages, the internet browser you use, your previous/next visited websites and the duration of a visit/session to enable us to deliver the functionalities of the Website. In addition, in certain instances the browser may prompt you for your geo-location to allow us to provide you with an enhanced experience. With this technical data our website administrators can manage the Website, for instance by resolving technical difficulties or improving the accessibility of certain parts of the Website. This way, we ensure that you can (continue to) find the information on the Website in a quick and simple manner.

 

3. Information you provide directly

 

Upon signing up with the Application, you will provide us your e-mail address, name, date of birth, gender and account password.

 

When you use the Application to find a dining and/or lifestyle privilege redemption, you provide us information such as your location and your destination. You also provide us information about the items you have purchasedyou use redeem a dining and/or lifestyle privilege. When you use our Application, we also process technical data such as your IP-address, Device ID or MAC-address, and information about the manufacturer, model, and operating system of your mobile device. We use this data to enable us to deliver the functionalities of the Application, resolve technical difficulties, provide you with the correct and most up to date version of the Application and to improve the function of the Application.

 

We may ask you for the phone number of a person who can be contacted when you use the Application. You must obtain the prior consent of the person whose phone number was provided to us by you for providing us the phone number.

 

You can share your referral code with your friend through the Application, for which, we will only prepare a message for you to send or publish through your social media provider or email provider. You can edit the message we have prepared before you send it. We do not collect your friends information.

 

4. Information we collect when you use the Application.

 

When you use the Application through your mobile device, we track and collect your geo-location information on a real-time basis. We use this information to allow you to view the Service Providers in your area who are close to your location so you can see what dining and/or lifestyle privileges you can redeem near you.. We may also use this real-time geo-location information to provide support, resolve technical or business issues that may arise in the course of your use of the Application. You can turn the geo-location tracking off at the device level temporarily. Your mobile device informs you when your geo-location is being tracked by displaying the GPS arrow icon.

 

5. Using the Information We Collect

 

We use your e-mail, name, phone number and/or account password to verify your ownership of an account, to communicate with you in response to dining and/or lifestyle privileges and to provide you information about the Application. We may also use your name, e-mail and phone number to send you news, general updates on the Application, special offers or promotions. We will also send you an e-mail asking you to subscribe to our Mailing List. You may at all times opt-out of receiving these updates.

 

We use your geo-location and destination to find Service Providers near you to allow you easier access to nearby dining and/or lifestyle privileges to analyze the pattern of use of the Application to improve the Application performance.

 

We use your Personal Information in an anonymized and aggregated form to closely monitor which features of the Services are used most, to analyze usage patterns and to determine where we should offer or focus our Services. You hereby agree that your data will be used for our internal data processing to provide better Services to you. 

 

6. Sharing the Information We Collect

 

We do not share any of your Personal Information with Service Providers. We may employ third party companies and individuals to facilitate or provide the Application and certain services on our behalf, to provide customer support, to perform Website-related services (eg without limitation, maintenance services, database management, web analytics and improvement of the Website's features) or to assist us in analyzing how our Service is used or to our professional advisors and external auditors, including legal advisors, financial advisors and consultants. These third parties only have access to your personal information in order to perform these tasks on our behalf and are contractually bound not to disclose or use it for any other purpose.

 

We do not share your Personal Information with any other parties without your consent. However, we will disclose your Personal Information to the extent that this is legally required, or necessary to comply with statutory, regulatory and governmental requirements, or in the event of any dispute, or legal proceeding of any kind between you and us, or between you and other users with respect to, or in relation to the Services, or in the event of an emergency pertaining to your health and/or safety.

 

Your Personal Information may be transferred to, stored, used and processed in a jurisdiction other than Indonesia where our servers are located. You understand and consent to the transfer of your Personal Information out of Indonesia.

 

We do not sell, rent or lease your Personal Information to third parties.

 

7. Retaining the Information We Collect

 

We will retain your information until you cancel your account in the Application.

  

8. Security

 

We do not guarantee the security of our database nor can we guarantee that the information you have provided will not be intercepted while being transmitted to us. Any transmission of information by you to us is at your own risk. You must not disclose your password and/or your PIN to anyone. As effective as technology is, no security system is impenetrable.

 

9. Changes to this Privacy Policy

 

We may amend this Privacy Policy to reflect changes in our practices. If we do so, we will inform you via email or by means of a notice on the Website and/or Application 1 day before the change becomes effective. We encourage you to periodically review this page for the latest information on our privacy practices.

 

10. Others

 

Language. This privacy policy is drawn up in both English and Indonesian language, both of which versions will be binding on you and us. In the event of inconsistency between the Indonesian language version and the English language version, the Indonesian language version will prevail.

 

Governing Law and Jurisdiction. This privacy policy is governed by and to be construed under the laws of the Republic of Indonesia. Any and all disputes arising from this privacy policy shall be governed by the exclusive jurisdiction of the South Jakarta District Court.

 

Acknowledgement and Consent. By using the Application, you acknowledge that you have read and understood this Privacy Policy and the Terms of Use and agree and consent to the use, practice, processing and transfer of your personal data by us as described in this Privacy Policy.

 

Unsubscribe from e-mail database. For email subscription, we follow the opt in and out policy. If you would like to stop receiving emails from the Company, please click unsubscribe included in every e-mail.
